MANGATAL, J

1. This trial is concerned with a motor vehicle accident which took place on

the 30th of October, 1996. On that date there was a collision between the

Claimant's motor vehicle registration #7103 AR and the 1"' Defendant's motor

bus registration# Temp. 12 1C at the intersection of Constant Spring Road and

South Avenue in the parish of Kingston.

2. The Claimant had in 2002 obtained interlocutory judgment against the

2"* Defendant who was the driver of the 1"' Defendant's motor vehicle. The

matter was fured for trial against the 1"' Defendant when the matter came

before me and I conducted the trial against the 1"' Defendant. The Claimant

elected not to proceed to assessment of damages against the 2" Defendant as

the 2nd Defendant had not been served with notice of this Court date.
