and the one which is the subject of this judgment, is an application by way of summons

made on behalf of the l*, 3rd and 4fh defendants and is:

"An application on the part of the Ist, 3rd and 4th Defendants for AN ORDER

THAT:

1. The action be dismissed as against the 1 st, 3rd and 4th Defendants:

(a) as disclosing no cause of action; andlor

(b) as being frivolous and vexatious and an abuse of the process of the court on

the grounds that:

i) the debt subject of the action is no longer the property of the 1st or 4th

Defendants; and,
