On January 25, 2002, a motor vehicle accident occurred on March Pen Road, St.

Catherine in which a car being driven by the defendant, Mr. Donald Jackson, caused

injury to the claimant, Shakira Dixon.

In the suit filed by Ms. Dixon it was alleged that it was Mr. Jackson's negligence

that caused the accident.

In his defence, he denied being negligent and said that it was Ms. Dixon's

negligence that caused the accident, or at least, materially contributed to it.

By this application Ms. Dixon seeks an Order to strike out Mr. Jackson's case and

to enter summary judgment. Further she seeks interim payment.
