BACKGROUND

On the 2"d July 1999 the ClaimantlRespondent filed suit seeking a

declaration that the DefendantlApplicant had infringed his copyrights and for

damages for such infringement.

On the loth day of November 1999, the DefendantiApplicant filed his

defence. In his defence he denied that he ClaimantlRespondent was the
